In Brazil, every study involving human beings is required to produce an informed consent form that must be signed by study participants: this is stated in Resolution 196/96. 1 Consent must be obtained through a specific structured process. Objective: To present the opinions of women regarding how the process of obtaining informed consent should be conducted when women are invited to participate in studies on contraceptive methods. Subjects and Methods: Eight focus groups were conducted, involving a total of 51 women (...) living in the metropolitan region of Campinas. The women involved in the study were either participating in a clinical trial in the area of women's health or had participated in such a trial in the previous 12 months. A thematic guide was used to conduct the focus group discussions; the discussions were recorded, transcribed and a thematic analysis performed. Results: In general, the person who invites a woman to participate in a study should be a member of the research team but not the principal investigator. Information relating to the study should be given orally and in writing, both individually and in the group setting. Study volunteers should be informed about, among other things, the risks, possible side effects and discomforts, including long-term effects. The use of audiovisual aids to provide information was suggested. Conclusion: The process for obtaining informed consent was seen as a means of establishing a relationship between the volunteers and the investigator/research team. The information that the study participants expected to be given coincides with the requirements established under Resolution 196/96. The use of audiovisual aids would improve understanding of the information provided. (shrink)

Silvana de Souza Ramos and Iracy Ferreira dos Santos Junior’s interview with Emmanuel de Saint Aubert explores the history and role of the Husserl Archives (Paris) in fostering multidisciplinary research in phenomenology. Saint Aubert clarifies Merleau-Ponty’s engagement with Husserl’s manuscripts, describing the situated and complex reading he undertook not only of these manuscripts but also of Husserl’s work as a whole. This aspect is particularly significant for contemporary French philosophical studies, as Merleau-Ponty played a pivotal role in introducing (...) Husserl’s ideas into French thought. This clarification allows us to show the originality of Merleau-Ponty’s philosophy, as it reveals that he was not merely an exegete of Husserl, but a restless and multifaceted thinker, deeply involved in the intellectual and political debates of his time. If he cannot be reduced to a mere reader of Husserl, neither can his later ontology be simply attributed to Heidegger’s influence. Once engaged in a meticulous study of the unfinished manuscripts that Merleau-Ponty left behind due to his premature death, which were drafts for a new book, Saint Aubert conducted a thorough investigation of Merleau-Ponty’s use of key terms in his ontology – chair, Leib, empiétement, chiasmi – showing that these terms do not literally translate or express concepts derived from Husserl or Heidegger. On the contrary, these terms acquire a multifaceted range of meanings in Merleau-Ponty’s writings, nourished by his philosophical readings and meditations, by his scientific and literary refinement, as well as his ethical and political concerns. Saint Aubert’s research, dedicated to the interpretation of Merleau-Ponty’s so-called “unpublished” works, resulted in the publication of five books by Vrin, all guided by a transversal genetic reading of Merleau-Ponty’s work. Additionally, with the help of other researchers, Saint Aubert carefully edited and published several volumes of Merleau-Ponty’s manuscripts. This material, made available in an organized and contextualized manner, is of incomparable richness, allowing for a more precise understanding of Merleau-Ponty’s role in contemporary thought, while also illuminating the meaning of his ontological project. Disfluencies include editing terms such as uh and um as well as repeats and revisions. Little is known about how disfluencies are processed, and there has been next to no research focused on the way that disfluencies affect structure-building operations during comprehension. We review major findings from both computational linguistics and psycholinguistics, and then we summarize the results of our own work which centers on how the parser behaves when it encounters a disfluency. We describe some new research showing that (...) information associated with misarticulated verbs lingers, and which adds to the large body of data on the critical influence of verb argument structures on sentence comprehension. The paper also presents a model of disfluency processing. The parser uses a Tree Adjoining Grammar to build phrase structure. In this approach, filled and unfilled pauses affect the timing of Substitution operations. Repairs and corrections are handled by a mechanism we term “Overlay,” which allows the parser to overwrite an undesired tree with the appropriate, correct tree. This model of disfluency processing highlights the need for the parser to sometimes coordinate the mechanisms that perform garden-path reanalysis with those that do disfluency repair. The research program as a whole demonstrates that it is possible to study disfluencies systematically and to learn how the parser handles filler material and mistakes. It also showcases the power of Tree Adjoining Grammars, a formalism developed by Aravind Joshi which has yielded results in many different areas of linguistics and cognitive science. (shrink)

O pensador esclarece qual foi o contato de Merleau-Ponty com os manuscritos de Husserl, e que tipo de leitura, situada e complicada, ele realizou não apenas desses manuscritos, mas da obra de Husserl como um todo. Esse aspecto é particularmente (...) importante para os estudos de filosofia francesa contemporânea porque Merleau-Ponty foi um dos grandes responsáveis pela introdução de Husserl no pensamento francês. Tal esclarecimento permite mostrar a originalidade da filosofia de Merleau-Ponty, pois revela que o autor não era um exegeta de Husserl, mas um pesquisador inquieto e multifacetado, engajado nos debates intelectuais e políticos de sua época. Se ele não pode ser reduzido à figura de um mero leitor de Husserl, tampouco sua ontologia tardia pode ser resumida à influência de Heidegger. Debruçado sobre os manuscritos deixados inacabados por Merleau-Ponty em função de sua morte prematura, os quais eram um esboço de um novo livro, Saint Aubert realizou um minucioso trabalho de pesquisa dos usos que Merleau-Ponty faz de termos centrais de sua ontologia – chair, Leib, empiétement, quiasma – mostrando que eles não traduzem ou expressam literalmente conceitos provenientes de Husserl ou de Heidegger, pelo contrário, esses termos ganham uma gama de sentido multifacetada nos escritos de Merleau-Ponty, alimentando-se de suas leituras e meditações filosóficas, mas também de sua cultura científica e literária, e de suas preocupações éticas e políticas. The role of Alfred Kinsey, America's most influential sexologist, in the cultural revolution of sex and gender during the past fifty years remains as unquestionable as it has been controversial. This admiring biography argues that Kinsey also qualifies as an authentic great man of science in the tradition of Darwin. Kinsey's expert authority was recently challenged by James Jones, who claimed in his 1997 biography that Kinsey's terrible personal secrets—homosexuality and masochism—plagued his life and ruined his science. Jonathan Gathorne‐Hardy (...) sets out to repair Kinsey's reputation by defending him against this “Kenneth Starr school of biography” . The author seeks to rescue Kinsey's achievement from the stigmatizing charge that it was flawed because it subordinated science to subjectivity.Gathorne‐Hardy emphasizes Kinsey's methodological creativity and his interviewing genius. During his early career, when he worked on gall wasps, Kinsey's science developed as a practice of scrupulous collection, observation, and documentation. Even in graduate school, he was dubbed “get a million Kinsey,” and his belief in sheer quantity—as well as quantification—was just as apparent when he turned his attention to human sexuality. In 1938 Kinsey taught a course on marriage at Indiana University, where he spent his entire working life. Limited to married or engaged students and faculty, the course covered reproductive physiology, contraception, and a host of other sexual topics in explicit detail. Kinsey also used the course to gather data about his students' sex lives. The thousands of sexual histories collected at the Institute for Sex Research in later years—7,985 by Kinsey alone—attest to his scientific commitment to behavior as the only legitimate basis for a science of sex.The behavioral unit of analysis chosen by Kinsey was the orgasm—or “outlet,” as Kinsey called it. Because it was countable, the theory went, it was objective. Kinsey's ethic of measurement resulted in interviews involving at least 350 standard questions, whose answers were recorded in a custom code designed to fit on a single sheet of paper divided into 287 squares. Among the ironies of Kinsey's method was the fact that his sex histories measured linguistic rather than sexual behavior. What Kinsey actually compiled was a huge cache of stories, not direct observations of sexual behavior. Kinsey, who gathered more sexual stories than any other person alive, systematically aimed to eradicate all quirks and complexities in order to produce a statistical portrait of population‐wide behavior. Meanings might be historically important, but numbers, not narratives, would yield truth. The easy use of “human males” and “human females” in the titles of Kinsey's famous reports suggests how universal his scientific claims were—and also how devoid of temporal and cultural particularity.The resulting conception of human sexual nature is probably best represented in Kinsey's six‐point scale, where behavioral possibilities ranged from exclusively homosexual at one pole to exclusively heterosexual at the other. Diversity emerged as the premier fact about sexual behavior. While this placed men and women uncomfortably close to their primate cousins on an evolutionary map, making human sexual exceptionalism objectively unsustainable, it also produced a reformist sensibility that rooted its demand for toleration in the powerful evidence of natural facts. It is difficult to overstate how shocking Kinsey's picture of polymorphous sexuality was in a culture devoted to either/or binaries and prone to harsh judgments about deviation from norms. Kinsey's contribution was to point out the gap between ideology and behavior . That lots of people did lots of things at odds with professed sexual morality was, for some, a welcome relief and call to revolution. For others, it was a reason to hate Kinsey and blame him for changes in the realm of gender and sexuality already well under way by midcentury.No biographies can save scientific heroes from the fatal charge that their methods and findings were bound up in their lives, or they would not be biographies worth reading. This attests to the stubborn endurance of the psychoanalytic paradigm. Kinsey despised Freud for passing off philosophy as science. Yet because of the conventions of post‐Freudian biography, Gathorne‐Hardy must explore exactly those dimensions of Kinsey's life and character that Freud embraced but that Kinsey himself would never have admitted into the precincts of science. His childhood illnesses and struggles with an overbearing father, his rage against religion, fondness for music, charismatic yet autocratic style, and his own anguished sexuality are keys to puzzling out not only a life in science, but a life.Gathorne‐Hardy can hardly ignore evidence that Kinsey's own sexual appetites were diverse—“bisexual” is this author's preferred designation—or that his enterprise in sex research involved experimentation: the mostly married male members of Kinsey's team were expected to engage in sexual activities with one another and one another's wives. Kinsey's wife Clara was a confidant and supporter from the start. Their loving marriage was also an open marriage. Mac was a participant‐observer in the world of sex research. She had a series of affairs with Kinsey's colleagues and even changed the bedsheets during energetic sessions of sexual cinematography that took place in the attic of their home. Yet the Kinseys also shielded their children from their own unorthodox sexual practices.This biography concludes by suggesting that Kinsey died tragically in 1957, convinced that his enemies had the upper hand. Kinsey was wrong. The diversity he championed has become a theoretical staple in the human and life sciences as well as a practical goal in social policies related to gender, race, and sexuality. However unfinished it may be, it is difficult to imagine Kinsey's revolution being reversed in either science or society. (shrink)

For 170 years, Harriet Taylor Mill has been presented as a footnote in John Stuart Mill’s life. This volume gives her a separate voice. Readers may assess for themselves the importance and influence of her ideas on "women’s" issues such as marriage and divorce, education, domestic violence, and suffrage. And they will note the overlap of her ideas on ethics, religion, arts, and socialism, written in the 1830s, with her more famous husband’s works, published 25 years later.

What “sort” of mind is required in order to be able to engage in aesthetic experiences? What are the marks of the aesthetic mind and which features distinguish aesthetic mental states? As humans, we are able not only to produce cognitions, feel emotions, use symbols, but also to engage in aesthetic and artistic experiences. How did our aesthetic mind arise over the course of evolution? Is it a by-product, or a side effect, of the development of our symbolic-linguistic competences or, (...) on the contrary, is precisely our aesthetic ability that allows the development of human language and symbolic thought? What is the relationship between the emergence of human modern mind and the origin of art? These are some of the challenging issues addressed during the International Conference The Aesthetic Mind and Origin of Art, held at the University of Florence, Department of Education, from January, 23rd to January 25th 2014. The essays collected in the present issue of «Aisthesis. Pratiche, linguaggi e saperi dell’estetico» mostly stem from talks originally delivered at the conference by leading researchers and international scholars across a wide range of disciplines. This paper addresses the topic of patenting related to the notion of Responsible Research and Innovation (RRI). Focusing on patents in the field of biotechnology, we assess to what extent current patenting practices of the European Patent Organization, and more specifically of its executive body, the European Patent Office (EPO) align with RRI principles. We first argue for including patenting as a relevant topic in the context of RRI and then provide an operationalisation of RRI principles that functions as an (...) analytic tool in the article. We find that the dimensions of RRI currently do not have a strong position in the EPO. Subsequently, we discuss the potential for improving the alignment of the EPO with RRI principles. We conclude the article with some final reflections on the applicability of RRI to the policies and practices of the European Patent Organization. (shrink)

Liberty is a new, expanded edition of what Isaiah Berlin himself regarded as his most important book - Four Essays on Liberty, a standard text of liberalism and constantly in demand since it was first published in 1969. Berlin's editor, Henry Hardy, has revised the text, incorporating a fifth essay that Berlin himself had hoped to include. He has also added further pieces that bear on the same topic, so that all Berlin's principal statements on liberty are at last (...) available together in one volume. (shrink)

The essays in this volume examine the nature of human flourishing and its relationship to a variety of other key concepts in moral theory. Some of them trace the link between flourishing and human nature, asking whether a theory of human nature can allow us to develop an objective list of goods that are of value to all agents, regardless of their individual purposes or aims. Some essays look at the role of friendships or parent-child relationships in a good life, (...) or seek to determine whether an ethical theory based on human flourishing can accommodate concern for others for their own sake. Other essays analyze the function of families or other social-political institutions in promoting the flourishing of individuals. The essays in this volume address questions about responsibility that arise in moral philosophy and legal theory. Some analyse different theories of causality, asking which theory offers the best account of human agency and the most satisfactory resolution of troubling controversies about free will and determinism. Some essays look at responsibility in the legal realm, seeking to determine how the law should assign liability for negligence, or whether the courts should allow defendants to offer excuses for their wrongdoing or to (...) claim some form of 'diminished responsibility'. Other essays explore libertarian views about political freedom and accountability, asking whether libertarian positions on consent, contract law, and responsibility are consistent, or whether restitution is superior to retribution or deterrence as a basis for a theory of corrective justice. Unlike other states, California retained a large proportion of the child care centers that had been established during World War II. In 1946, the California state government allocated state funds for child care in response to a vigorous child care campaign. The campaign, which was, in large part, a working mothers movement, was a “transformed maternalist” movement. It used maternalist rhetoric to defend state-subsidized child care that was criticized by more traditional maternalists. Using resource mobilization theory, I explain the relatively (...) high degree of political mobilization on the child care issue in California in terms of the greater availability of co-optable social resources, which California's relatively large wartime child care program provided, and the existence of movement entrepreneurs willing to mobilize these latent resources. Child care advocates were successful because they operated within a relatively favorable political opportunity structure since they did not have to contend with a strained state treasury or a mobilized countermovement and were able to garner the support of a wide variety of women's and social organizations and an influential social reformer. Although affective facial pictures are widely used in emotion research, standardised affective stimuli sets are rather scarce, and the existing sets have several limitations. We therefore conducted a validation study of 490 pictures of human facial expressions from the Karolinska Directed Emotional Faces database (KDEF). Pictures were evaluated on emotional content and were rated on an intensity and arousal scale. Results indicate that the database contains a valid set of affective facial pictures. One antidote to moral distress is stronger moral agency—that is, an enhanced ability to act to bring about change. The Clinical Ethics Residency for Nurses, an educational program developed and run in two large northeastern academic medical centers with funding from the Health Resources and Services Administration, intended to strengthen nurses’ moral agency. Drawing on Improving Competencies in Clinical Ethics Consultation: An Education Guide, by the American Society for Bioethics and Humanities, and on the goals of the nursing profession, CERN (...) sought to change attitudes, increase knowledge, and develop skills to act on one's knowledge. One of the key insights the faculty members brought to the design of this program is that knowledge of clinical ethics is not enough to develop moral agency. In addition to lecture‐style classes, CERN employed a variety of methods based in adult learning theory, such as active application of ethics knowledge to patient scenarios in classroom discussion, simulation, and the clinical practicum. Overwhelmingly, the feedback from the participants (sixty‐seven over three years of the program) indicated that CERN achieved transformative learning. (shrink)

What changes when an evolutionary transition in individuality takes place? Many different answers have been given, in respect of different cases of actual transition, but some have suggested a general answer: that a major transition is a change in the extent to which selection acts at one hierarchical level rather than another. The current paper evaluates some different ways to develop this general answer as a way to characterise the property ‘evolutionary individuality’; and offers a justification of the option taken (...) in Clarke :413–435, 2013)—to define evolutionary individuality in terms of an object’s capacity to undergo selection at its own level. In addition, I suggest a method by which the property can be measured and argue that a problem which is often considered to be fatal to that method—the problem of ‘cross-level by-products’—can be avoided. In the past 20 years or so, the psychological research on imitation has flourished. However, our working definition of imitation has not adequately adapted in order to reflect this research. The closest that we've come to a revamped conception of imitation comes from the work of Michael Tomasello. Despite its numerous virtues, Tomasello's definition is in need of at least two significant amendments, if it is to reflect the current state of knowledge. Accordingly, it is our goal in this paper (...) to reformulate Tomasello's definition of imitation in order to account for both the latest empirical findings and the conceptual considerations that follow from them. Specifically, we argue that a satisfactory definition of imitation ought to be formulated as follows: imitation is the reproduction of an observed behavior where the agent imitating recognizes the behavior of the demonstrator as goal-directed and has some particular interest in or concern for replicating the precise technique performed by the aut.. For a little more than a decade, professional organizations and healthcare institutions have attempted to develop guidelines and policies to deal with seemingly intractable conflicts that arise between clinicians and patients (or their proxies) over appropriate use of aggressive life-sustaining therapies in the face of low expectations of medical benefit. This article suggests that, although such efforts at conflict resolution are commendable on many levels, inadequate attention has been given to their potential negative effects upon particular groups of patients/proxies. Based (...) on the well-documented tendency among many African Americans to prefer more aggressive end-of-life medical interventions, it is proposed that the use of institutional policy to break decision making impasse in cases for which aggressive treatment is deemed "medically inappropriate" will fall disproportionately on that group. Finally, it is suggested that the development and application of institutional conflict-resolution policies should be evaluated in the context of historical and current experiences of marginalization and disempowerment, lest such policies exacerbate that experience. In "'Yes" and "No'" (2000), Ian Rumfitt proposed bilateralism--a use-based account of the logical words, according to which the sense of a sentence is determined by the conditions under which it is asserted and denied. One of Rumfitt's key claims is that bilateralism can provide a justification of classical logic. This paper raises a techical problem for Rumfitt's proposal, one that seems to undermine the bilateralist programme.

Biomedical research has always relied on access to human biological materials and clinical information, resources that when combined form biobanks. In the past, it appears that investigators sometimes used these resources with relatively little oversight, and without the consent of the individuals from whom these materials and information were obtained. Several developments in the last ten to fifteen years have converged to place greater emphasis on the role of individual consent in the creation and use of biobanks. The most important (...) by far is the power of information technology, which has transformed our lives in almost every domain. In the research setting, it is now easy to abstract information from electronic medical records. Computers make it possible to analyze enormous datasets and have contributed in essential ways to the dramatic increases in our understanding of genomics and other areas of biomedical science. In the current literature, discussions of cognitive penetrability focus largely either on interpreting empirical evidence in ways that is relevant to the question of modularity :343–391, 1999; Wu Philos Stud 165:647–669, 2012; Macpherson Philos Phenomenol Res, 84:24–62, 2012) or in offering epistemological considerations regarding which properties are represented in perception :519–540, 2009, Noûs 46:201–222, 2011; Prinz Perceptual experience, Oxford University Press, Oxford, pp 434–460, 2006). In contrast to these debates, in this paper, I explore conceptual issues regarding how we ought (...) to understand the “cognitive” side of cognitive penetrability. I argue that it is only on its most narrow construal that a full-fledged defense of cognitive impenetrability has been forwarded. Specifically, I argue that the defenders of modularity have tacitly identified cognitive states with propositional states, and have thus only defended the idea that early perceptual systems are immune to the impacts of propositional knowledge. My aim then is to raise doubts about the identification of cognitive states with propositional ones. In particular, by focusing on skill, I will broaden the conceptual space for a greater number of states to have the potential to impact perceptual processing in a way that would constitute a genuine instance of cognitive penetrability. Myriad Genetics holds a patent on testing for the hereditary breast and ovarian cancer genes, BRCA1 and BRCA2, and therefore has a forced monopoly on this critical genetic test. Myriad launched a Direct-to-Consumer (DTC) marketing campaign in the Northeast United States in September 2007 and plans to expand that campaign to Florida and Texas in 2008. The ethics of Myriad's patent, forced monopoly and DTC campaign will be reviewed, as well as the impact of this situation on patient access and (...) care, physician liability, and the future of DTC campaigns for genetic testing. Purity has been recognized as an ideal of proof. In this paper, I consider whether purity continues to have value in contemporary mathematics. The topics (e.g., algebraic topology, algebraic geometry, category theory) and methods of contemporary mathematics often favor unification and generality, values that are more often associated with impurity rather than purity. I will demonstrate this by discussing several examples of methods and proofs that highlight the epistemic significance of unification and generality. First, I discuss the examples of algebraic (...) invariants and of considering a mathematical object from several different perspectives to illustrate that the methods used in contemporary mathematics favor impurity. Then I consider an example from category theory which demonstrates how unification and generality are related to impurity and that impure solutions can be explanatory. In light of this discussion, we see that purity only has marginal value within contemporary mathematics which instead prioritizes the epistemic values associated with impurity. (shrink)
